Public domain هذا فلمٌ يابانيٌّ أو صُورةٌ مِن فلم يابانيٌّ أُنتج قبل العام 1953م، أَخرجه شخصٌ تُوفِّي منذ أكثر من 38 عاماً وهو الآن في النِّطاق العامِّ.

حكمت محكمةٌ يابانيَّةٌ في يوليو من العام 2006م باستثناء الأفلام المُنتجَة في اليابان قبل العام 1953م جميعها مِن التَّغيير الَّذي حصل لقانون حقوق التَّأليف والنَّشر للأعمال السِّينمائية الَّذي زاد مدة الحماية من 50 إلى 70 عاماً بعد النشر. [1][2][3].

لكن محكمة طوكيو حَكمت في 17 سيتمبر 2007 بأنَّ الأفلام الَّتي أخرجها أكيرا كيروساوا (ت. 1998) ستظلُّ مَحميةً بحقوق التَّأليف والنَّشر حتى العام 2036م أَي أنَّها ما تزال خاضِعةً للقانون القديم الَّذي أُلغي في عام 1971م والَّذي يحمي أعمال المُؤَلِّفين لمدة 38 سنة بعد وفاتهم.

في عام 2008م، أكَّدت المحكمة العليا للملكية الفكرية حكم المحكمة ذات الدرجة الأدنى. وجاء في القرار بأن "المحكمة العليا اليبانية للملكية الفكرية تحكم بصحة قرار مَحكمة طوكيو الصَّادِر في سبتمبر 2007م" و بأن "حقوق التَّأليف والنَّشر للأفلام سارية لمدة 38 عامًا من العام التَّالِي لوفاة المخرج".

الرجاء الانتباه إلى أن الأعمال الواقعة في النِّطاق العام يلزم أن تكون دون حقوق تأليفٍ ونشرٍ في الولايات المُتحدة وفي بلد المنشأ أيضاً ليكون بالإمكان استضافتها في كُومِنز. يَلزم أن يحتوي هذا الملف أيضاً وسم حقوق تأليفٍ ونشرٍ يُحدِد حالة حُقوق التَّأليف والنَّشر في الولايات المُتَّحدة أيضاً. انظر قوانين حُقوق التَّأليف والنَّشر حسب البلد.

Public domain According to Japanese Copyright Law (June 1, 2018 grant), the work is now in the public domain in Japan because the copyrights of the works in names of organizations, in Japan expire in 50 years after the publication, or in 50 years after the creation if the works are not published within 50 years after the creation (article 53).
